1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the BeWell mobile application, Wear OS companion software, synchronization APIs, and related digital services (collectively, the "Service"), operated by GeekyWebTech ("we", "us", or "our").

By installing, downloading, registering for, or using BeWell, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use and uninstall the app.

2. Eligibility & Account Security

• Age Requirement: You must be at least 13 years old (or the legal age of majority in your jurisdiction) to use BeWell.
• Accurate Information: You agree to provide true and accurate information during onboarding, including approximate biometric parameters (height, weight, age) for calorie and step estimation.
• Credential Protection: You are responsible for safeguarding your login credentials (password, Google Sign-In, OTPs). You must notify us immediately at support@geekywebtech.com upon detecting any unauthorized access.
• One Person per Account: Accounts are personal to you and may not be shared, sold, or transferred to other individuals.

3. Medical & Fitness Disclaimer

Always consult with a licensed physician or qualified medical professional before commencing any new exercise routine, walking challenge, or weight management regimen. If you experience chest pain, dizziness, shortness of breath, or joint discomfort during physical activity, stop immediately and seek emergency medical assistance.

4. Hardware Sensors, GPS & Battery

• Hardware Variations: Step counting relies on your device's built-in accelerometer and pedometer sensor. Step counts, cadence, and active minutes may vary based on hardware specifications, device orientation, and manufacturer battery optimization.
• GPS Reception: Outdoor workout tracking requires an unobstructed line-of-sight to GPS satellites. Tall buildings, underground tunnels, heavy tree canopies, and dense weather may degrade route accuracy.
• Wear OS Synchronization: Smartwatch data sync depends on Bluetooth connectivity, local Wi-Fi, and background OS scheduling. BeWell is not liable for delayed sync intervals caused by third-party watch operating systems.

5. Community Guidelines & Social Circles

When participating in Friends & Family Circles, step challenges, or group leaderboards, you agree not to:

• Upload falsified, manipulated, or artificially generated step data via hardware shakers, automated scripts, or software mock location emulators
• Transmit harassing, abusive, defamatory, or unlawful content in profile names or avatar photos
• Interfere with or disrupt the security, integrity, or network connections of BeWell servers
• Reverse-engineer, decompile, disassemble, or derive source code from any portion of the app

6. Intellectual Property Rights

The BeWell application, brand wordmark, Gopron typography, official running lotus leaf emblem, kinetic peristaltic loader visual assets, custom UI themes, animations, audio-haptic patterns, database schemas, and proprietary algorithms are the exclusive intellectual property of GeekyWebTech and are protected by applicable trademark, copyright, and trade secret laws.

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on personal mobile and smartwatch devices for personal, non-commercial fitness tracking.

7. Account Deletion & Termination

You may terminate these Terms at any time by deleting your account inside the BeWell app via Profile → Settings → Delete Account & Data, or via our web request portal at www.geekywebtech.com/bewell/delete-account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in artificial step manipulation, or compromise system stability, with or without prior notice.

8. Limitation of Liability & Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF BIOMETRIC ESTIMATES, OR UNINTERRUPTED OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GEEKYWEBTECH AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING INJURY ARISING FROM PHYSICAL EXERTION, LOSS OF BIOMETRIC DATA, OR DEVICE INCOMPATIBILITY.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
