Terms and Conditions for TrackiFi

Welcome to TrackiFi! These terms and conditions outline the rules and regulations for the use of the TrackiFi mobile application (hereinafter referred to as "the App").

By downloading, installing, accessing, or using the TrackiFi mobile application, you signify your agreement to be bound by these Terms and Conditions. If you disagree with any part of these terms, you must not use our App.

1. Acceptance of Terms

By using TrackiFi, you confirm that you have read, understood, and agree to comply with these Terms and Conditions, as well as our Privacy Policy (available at https://www.geekywebtech.com/privacy-policy). These documents constitute a legally binding agreement between you and the providers of TrackiFi.

2. Use of the App

License:

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use TrackiFi on a mobile device owned or controlled by you, solely for your personal, non-commercial financial management purposes, strictly in accordance with these Terms.

SMS Processing:

To enable automatic expense tracking, TrackiFi requires permission to read your transactional SMS messages. The App processes these messages locally on your device or sends relevant data to our secure servers to categorize transactions and provide financial insights, as detailed in our Privacy Policy. You acknowledge and agree that the accuracy and availability of SMS-based tracking depend on messages sent by financial institutions and your device's SMS capabilities and permissions.

Manual Data Entry:

You may also manually input cash transactions and other financial data into the App. You are responsible for the accuracy of any data you manually enter.

Prohibited Activities:

You agree not to engage in any of the following prohibited activities:

• Violating any applicable local, state, national, or international laws or regulations.
• Using the App for any fraudulent, unlawful, or malicious purposes.
• Modifying, adapting, translating, reverse-engineering, decompiling, disassembling, or attempting to derive the source code of the App or any part thereof.
• Attempting to gain unauthorized access to the App's systems, networks, user accounts, or data.
• Interfering with or disrupting the integrity or performance of the App or the data contained therein.
• Using the App in any manner that could damage, disable, overburden, or impair Our servers or networks (if applicable).
• Transmitting any viruses, worms, defects, Trojan horses, or any items of a destructive nature.

3. User Accounts

Registration:

To use most features of TrackiFi, you must register for an account using your mobile number. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security:

You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify Us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

OTP Verification:

Account registration and certain actions may require OTP (One-Time Password) verification sent to your registered mobile number.

4. Privacy and Data

Privacy Policy:

Our Privacy Policy, available at https://www.geekywebtech.com/privacy-policy, explains how We collect, use, store, and disclose your personal information and financial data. By using TrackiFi, you consent to Our collection, use, and disclosure of your information as described in the Privacy Policy.

Data Backup:

We strive to ensure your financial data is securely maintained. However, you acknowledge that no system is entirely infallible, and We are not responsible for any loss of data, unless due to Our gross negligence or willful misconduct. We recommend you maintain your own backups where possible.

Data Accuracy:

While TrackiFi employs intelligent algorithms for SMS parsing and categorization, We do not guarantee the absolute accuracy of automatically tracked data. You are encouraged to review and verify your transactions and categorizations.

5. Intellectual Property

Ownership:

All rights, title, and interest in and to the App (including but not limited to all content, software, code, designs, graphics, text, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code, and the design, structure, selection, coordination, expression, "look and feel," and arrangement of such content) are and will remain the exclusive property of the developers of TrackiFi and its licensors.

Restrictions:

You may not use, copy, modify, distribute, sell, lease, or reproduce any part of the App or its content, nor may you reverse engineer or attempt to extract the source code of the software, unless laws prohibit these restrictions or you have Our prior written permission.

6. Disclaimers and Limitation of Liability

"As Is" Basis:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT DEFECTS WILL BE CORRECTED.

Financial Information:

TRACKIFI IS A FINANCIAL INFORMATION AND MANAGEMENT TOOL AND IS NOT INTENDED TO PROVIDE FINANCIAL, INVESTMENT, LEGAL, OR TAX ADVICE. YOU ARE SOLELY RESPONSIBLE FOR YOUR FINANCIAL DECISIONS.

Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPERS OF TRACKIFI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL BE LIMITED TO THE MINIMUM AMOUNT PERMITTED BY LAW, OR A NOMINAL SUM (E.G., USD 1.00) IF NO PAYMENT HAS BEEN MADE FOR THE APP.

7. Modifications to Terms or App

Changes to Terms:

We reserve the right, at Our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, We will make reasonable efforts to provide at least [e.g., 15-30] days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion. Your continued use of the App after any such changes become effective constitutes your acceptance of the new Terms and Conditions.

Changes to App:

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice and without liability to you.

8. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use the App will immediately cease.

9. Governing Law and Dispute Resolution

Jurisdiction:

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts.
